Sonderbestimmungen Covid-19
Aufgrund der Covid-19-Pandemie ist jede*r Teilnehmer*in beim Besuch der Veranstaltung vor Ort dazu verpflichtet, die Vorgaben und Auflagen des Landes Berlin– insbesondere der zum jeweiligen Zeitpunkt geltenden Verordnung zum Schutz vor Neuinfizierungen mit dem Coronavirus SARS-CoV-2 (SARS-CoV-2-Infektionsschutzmaßnahmenverordnung) – und der zuständigen Behörden sowie die bundesgesetzlichen Vorgaben einzuhalten. Ebenso sind das Schutz- und Hygienekonzept der Veranstalterin sowie die getroffenen angemessenen Maßnahmen der Veranstalterin zum Infektionsschutz zu befolgen. Der*die Teilnehmer*in hat sich vor dem Besuch der Veranstaltung bezüglich dieser Vorgaben zu informieren und an diese zu halten. Die Veranstalterin ist berechtigt, bei Verstößen des*der Teilnehmer*in angemessene Maßnahmen zur Verhinderung weiterer Verstöße zu ergreifen, insbesondere kann ein Ausschluss von der Veranstaltung erfolgen. Eine Entschädigung steht dem*der Teilnehmer*in in einem solchen Fall nicht zu. Sofern der Veranstalterin infolge eines schuldhaften Verstoßes des*der Teilnehmer*in Geldstrafen oder Sanktionen auferlegt werden, ohne dass eigenes Verschulden der Veranstalterin vorliegt, kann dieser den*die Teilnehmer*in entsprechend in Regress nehmen.
Der*die Teilnehmer*in erkennen an, dass infolge der Covid-19-Pandemie Veranstaltungen ggf. nur in eingeschränkter Form stattfinden können oder kurzfristig abgesagt werden müssen und dass die Teilnahme an einer Vor-Ort-Veranstaltung die Einhaltung von Infektionsschutzmaßnahmen und die diesbezügliche Mitwirkung des*der Teilnehmer*in erfordern kann. Sofern eine Veranstaltung aufgrund behördlicher Anordnung, Schutzmaßnahmen der Veranstalterin oder sonstigen Gründen im Zusammenhang mit der Covid-19-Pandemie abgesagt wird und ausfällt, verlieren die bereits erworbenen Tickets ihre Gültigkeit. Dem*Der Teilnehmer*in wird der Ticketpreis in Form einer Rücküberweisung zurückerstattet.
Die Veranstalterin ist berechtigt, angemessene Schutzmaßnahmen zur Eindämmung der Covid-19 Pandemie zu treffen. Hierbei wird sich die Veranstalterin an den behördlichen Empfehlungen orientieren. Hierzu können bspw. folgende, nicht abschließende Maßnahmen, zählen:
- Erhebung und Verarbeitung von personenbezogenen Daten zur Kontaktnachverfolgung
- Einlass und Kontrolle der personalisierten Tickets
- Zeitlich gestufter Einlass der Ticketinhaber
- Verwehrung des Zutritts bei bekannter, aktueller Erkrankung an COVID-19 sowie bei Symptomen (gemäß Robert Koch Institut), die auf eine Covid-19-Infektion hinweisen
- Schutz- und Hygienekonzept
- Beschränkung der Zuschauerzahl
- Vorlage negativer Coronatest (nicht älter als 12 Stunden)
- Nachweis Impfung oder der Genesung von einer Corona-Infektion.
Covid-19 regulations
Due to the Covid-19 pandemic, all participants attending the event are obliged to comply with the regulations and requirements of the State of Berlin and the responsible authorities – in particular the regulations for protection against new infections with the SARS-CoV-2 coronavirus – as well as with the requirements of federal law. Likewise, the protection and hygiene concept of the organizer as well as the appropriate measures taken by the organizer to protect against infection must be followed. The participant must inform himself/herself about these requirements before attending the event and adhere to them. In the event of violations by the participant, the organizer is entitled to take appropriate measures to prevent further violations; in particular, the participant may be excluded from the event. The participant shall not be entitled to any compensation in such a case. If fines or sanctions are imposed on the organizer as a result of a culpable violation by the participant, without the organizer being at fault, the organizer may take recourse against the participant.
The participant acknowledges that as a result of the Covid-19 pandemic, events may only be able to take place in a restricted form or may have to be cancelled at short notice and that participation in an on-site event may require compliance with infection control measures and the participant’s cooperation in this regard. If an event is cancelled due to official orders, protective measures of the organizer or other reasons in connection with the Covid-19 pandemic, the tickets already purchased lose their validity. The ticket price will be refunded to the participant in the form of a remittance.
The organizer is entitled to take appropriate protective measures to contain the Covid-19 pandemic. In doing so, the organizer will follow the recommendations of the authorities. These may include, for example, the following non-exhaustive measures:
- Collection and processing of personal data for contact tracing purposes
- Admission and control of personalized tickets
- Phased admission of ticket holders
- Denial of access in the event of a current COVID-19 illness or symptoms (according to the Robert Koch Institute) that indicate a Covid-19 infection
- Protection and hygiene concept
- Restriction of the number of participants
- Presentation of negative PCR or antigene test (not older than 12 hours)
- Evidence of vaccination or recovery from corona infection.
